Government employee cannot be denied medical reimbursement due to delay

MADRUAI: The Madras High Court bench here has ruled that a government employee could not be denied medical reimbursement just because he had delayed the claim.

Justice Vinod Kumar Sharma, allowing a writ petition by S Govinda Rao, said the 60 day period (for applying) prescribed by the government in an August 8 2000 letter could not be held mandatory to deny the right of reimbursement to which the employee was entitled under service rules. He quashed the Thanjavur District Elementary Educational Officer's May 10, 2005 order, rejecting the petitioner's plea for reimbursement and directed the official to process the application and release the payment within two months. The Petitioner said he underwent the surgery in a hospital in Thanjavur district in March 1999 and filed the claim on Jun 16,1999, seeking reimbursement of 75 per cent of the expenses recurred on the surgery

Ombudsman asks insurance firm to settle claim it rejected

Pune: Manish Chadha, a Pune-based hotelier, has won a case against Bajaj Allianz General Insurance Company Ltd (BAGICL) — which refused to entertain his medical claim — before the Insurance Ombudsman (Maharashtra and Goa).

Chadha had chosen to approach the insurance ombudsman instead of the district consumer forum after the insurance company refused to acknowledge that panic and anxiety, for which he was treated, were not the commonly perceived psychiatric disorder but a condition arising out of cardiac complications. “All these when the company itself had settled a similar claim in 2008,” Chadha said.
Chadha, who also owns a legal consultancy firm, was at a popular jewellery shop on Karve Road on October 5, 2010, when he started to sweat profusely, had severe palpitations besides suffering giddiness. “I was rushed to the nearby Sanjeevan Hospital and was discharged the next day. The discharge card stated ‘panic disorder and anxiety’ and advised Chadha to do a cardiac review from Jehangir Hospital as the required equipment was not available there.”
Chadha filed a claim under the Health Guard Policy for Rs 8,311 with a copy of the discharge card and other documents on October 7. The company repudiated the claim, citing ‘Psychiatric illness/ psychiatric treatment’ that is excluded from the policy. “I wrote back to them and attached letters from Sanjeevan Hospital’s doctors that the panic disorder and anxiety were related symptoms to cardiac ailments and that I was not given any psychiatric treatment,” he said. ”Though the amount was not big, I decided to pursue the claim because of discrepancies shown by BAGICL. After I filed the claim, I received a letter on October 25 asking for more documents. Within 24 hours, the same person sent me another letter repudiating the claim.”
On December 28, 2010, Chadha received another communique from the company that he needs to complete the cardiac review in Jehangir Hospital. Though the cardiac review reports indicated ‘sinus tachycardia’ as the final diagnosis, the company continued to refuse the claim.
Chadha approached the Insurance Ombudsman (Maharashtra and Goa) in Mumbai on November 10, 2010. Assistant manager Vikram Ravindranathan and Dr Rashmi Sachdev represented BAGICL before Insurance Ombudsman S Vishwanathan.
After hearing both sides, the Ombudsman — in the order dated July 29, 2011 — observed that Chadha’s case was of ‘tachychardia manifested by way of severe palpitations and increased heart rate with panic attack which cannot be termed as ‘psychiatric illness’ and hence repudiation of the claim was not justified.’ The Ombudsman directed the company to settle the claim of Rs 8,311 and pay the balance of Rs 1,000 under cash benefit scheme within three working days.
Sudhakar Velankar, former president and trustee of consumer rights’ group Grahak Hitvardhini, said the case was important considering that the decision came from the ombudsman. “Only a few people approach the insurance ombudsman and the percentage of cases disposed in favour of the consumer is even lower.”

Life insurers' Q1 premium dips 28%

New Delhi: The life insurance industry has witnessed a 28 per cent decline in total premium collection at Rs 18,282.85 crore in the first three months of the current fiscal.

The 23-player life insurance industry had collected premium worth Rs 25,522.2 crore in the April-June period of the previous fiscal, according to data compiled by Insurance Regulatory and Development Authority (IRDA).
Led by country's largest insurer LIC, a majority of the insurance companies have seen a decline in their premium income.
During the first quarter of the current fiscal, Life Insurance Corporation (LIC) saw its premium income decline by 25 per cent to Rs 14,061.35 crore.
The remaining 22 private companies saw their total premium income declined 38 per cent to Rs 4,221.5 crore at the end of June.
However, the general insurance industry witnessed an impressive 22 per cent growth in their total premium income to Rs 14,045.87 crore in the April-June quarter of current fiscal.
The 24 player industry, with four public sector players, had a premium income of Rs 11479.64 crore in the June quarter of FY '10.

IRDA to do away with mandatory 4.5% return on pension schemes

New Delhi: The insurance regulator IRDA today proposed doing away with the assured 4.5 per cent return norm for pension schemes and introduced mandatory disclosure of assured benefits upfront to the customers.

"A pension product shall have an assured benefit disclosed at the time of sale...in absolute terms which becomes payable on the vesting date," the Insurance regulatory and Development Authority (IRDA) said in a draft guideline for pension products.
The IRDA proposed to modify the guidelines as the earlier norm of assured 4.5 per cent return did not find favour with life insurance companies.
Since the implementation of the guidelines on pension products from September 1, 2010, only five out of 23 life insurance companies came out with pension or ULIP product.
The regulator has said that the insurance companies would provide a "minimum return on the premiums paid during the period of contract, which shall be disclosed at the time of purchase of contract."
The insurance company at the time of sale of policies would have to make an illustration of the returns which it is expected to provide, in the range of 4-6 per cent, to the policyholders.
